1. Competition

WINKEY operates skill-based prize competitions. By purchasing tickets and entering our draws, you agree to these Terms & Conditions.

Competitions are open to residents worldwide aged 18 and over, excluding jurisdictions where participation is prohibited, including any territories listed in our website. These Terms are governed by English law (United Kingdom); section 7 sets out jurisdiction and disputes.

Employees, contractors, agents of WINKEY and anyone professionally connected with the competitions are not eligible to enter.

To enter online, you select the number of tickets, answer a skill-based question correctly, and pay for your tickets. You may also enter by free postal entry in line with the instructions on our website. Your entry is only confirmed once we have acknowledged it—either when payment has been received and processed (online entries), or when we have validated your postal entry and confirmed it by email or through your registered account (postal entries). All online ticket purchases are final and non-refundable unless the competition is cancelled by us or we are required to refund by law.

Entries will be cancelled if any payment is reversed or charged back. We are not responsible for incomplete, delayed, damaged or unreceived entries for any reason.

2. Prizes

Each draw provides participants with the chance to win the prize(s) described on the competition page, typically a luxury car or any runner-up prizes indicated. Prizes are as specified on our website. We may substitute a prize with another of equivalent commercial value where reasonably necessary, at our discretion.

If it becomes genuinely impossible to supply or deliver the advertised prize—for example due to supplier issues, import or regulatory restrictions, force majeure, or other circumstances beyond our reasonable control—we may offer the winner either a substitute vehicle or other prize of equivalent commercial value, or, only as a last resort and at our sole discretion, a cash payment not exceeding the retail value (including VAT, where applicable) of the advertised prize as shown on the competition page at the time of the draw.

Winners will be drawn at random from all correct entries, usually within 14 days of the competition closing. Winners will be notified via the email address provided and prizes delivered to the agreed address. If contact cannot be made or delivery fails despite reasonable attempts, the prize may be forfeited and offered to another entrant.

Delivery of a vehicle normally takes between 5 and 21 days after the draw, but this is not guaranteed and may be affected by location and logistics.

Any prize—whether a vehicle, other goods, or a cash payment—may give rise to income tax, capital taxes, withholding, or other levies in your country of residence (and elsewhere as applicable). You are solely responsible for declaring and paying all such taxes and for any import duties, VAT, shipping, registration, or similar costs relating to the prize. Nothing in these terms constitutes tax advice; you should seek independent professional advice if you are unsure of your obligations.

3. Winners

We may request proof of identity, age and ownership or authorised use of the payment method used before releasing any prize. If the card or account used does not belong to the winner, we may require proof of authorisation from the cardholder. Required documents must be provided within the timeframe stated in the winner notification.

Winners must confirm acceptance of the prize in writing within the timeframe specified in the notification email and agree delivery arrangements shortly thereafter. Failure to do so may result in forfeiture and selection of an alternative winner.

Winners may be asked to participate in reasonable publicity, such as photographs or videos of the handover, which may be used by WINKEY on our website and social channels. You can withdraw consent for future use by contacting us in writing.

4. Website Use

This website is operated by WK Business Ltd (trading as WINKEY). By using the site you agree not to breach any laws, infringe any rights, disrupt the site, attempt unauthorised access or use automated means (bots, scrapers etc.) without our consent.

We do not guarantee that the website will be available, error free or up to date at all times and we may suspend or change any part of the site without notice. We are not responsible for any third-party sites or services linked from our website.

Personal data is processed in accordance with our Privacy Policy and Cookies Policy, which may be updated from time to time.

5. Accounts & Chargebacks

Accounts are for personal use only and must be kept secure. You are responsible for keeping your login details confidential and for all activity on your account. We may suspend or terminate accounts at our discretion, including in cases of suspected fraud or breach of these terms.

If you have any concerns about a charge on your account, please contact us first. We are committed to resolving issues promptly. Unwarranted chargebacks may result in forfeiture of prizes and suspension or closure of your account.

6. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law.

Subject to this, we are not liable for losses that are not caused by our breach of a legal duty, that were not reasonably foreseeable, that are caused by your own acts or omissions, or that relate to business losses such as loss of profit, revenue, data or goodwill. You are responsible for any foreseeable losses we incur as a result of your breach of these terms or misuse of our services.

7. Law, Jurisdiction & Complaints

These Terms & Conditions are governed by English law. Any disputes will be subject to the courts of England and Wales, without prejudice to any mandatory consumer protections in your country of residence.

If any part of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. We may transfer our rights and obligations under these terms to another organisation, but this will not affect your rights.

8. Local laws & your responsibilities

Rules on prize competitions, skill-based promotions, and paid entry differ from one country or region to another. Participating in our competitions is not lawful in every jurisdiction, and we do not warrant or guarantee that entry or use of this website complies with the laws where you live or from which you access our services.

You are solely responsible for making sure that your participation is permitted under all regulations, licensing rules, and other requirements that apply to you. If you are unsure whether you may lawfully enter, you should obtain independent legal or professional advice before purchasing tickets or entering.

9. Restricted Countries

Due to legal restrictions, players from certain countries (including Germany and any other territories listed on our website from time to time) are not allowed to participate. Entries from restricted countries will be void and we will refund ticket payments where reasonably possible, unless prohibited by law.
